The federal appeals court has maintained a prohibition on deploying national guard in Portland, Oregon, after a latest court ruling.

Judicial Panel Concurs to Reconsider Legal Matter

The federal appeals court ruled on Tuesday that it would reexamine the case concerning the president’s authority with an larger panel of eleven justices. The court also vacated a previous decision from a smaller judicial group that had sided with the administration.

Legal Saga Over Troop Deployment

This order represents the most recent development in a protracted court case over whether the former president has the legal right and justification to send national guard forces in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was initiated in due to months of protests.

Conflicting Arguments

The federal government has claimed that government employees at the immigration center in south Portland were under attack, while city and state officials assert that municipal police have command of the situation.

In defiance of descriptions of the city as a conflict zone, residents have been sharing videos of lush hiking trails and a vibrant culinary culture, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in Portland issued two legal injunctions this period – one blocking the federal control of the Oregon national guard, and another prohibiting the deployment of any military personnel in the state, after attempts to evade the first order by calling up out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – allowing control of 200 Oregon national guard – but the second ruling stayed effective, preventing the actual deployment of the troops.

Full Panel Consideration

The Tuesday decision means the issue will be heard “en banc” – with both rulings under review simultaneously – by a panel of eleven justices.

“This ruling shows that facts are important and that the courts are working to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot send the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, principles, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
